Refund and Cancellation Policy

How refunds and cancellations are handled for our immigration consulting services.

Scope of This Policy

This policy applies to fees paid for Canadian work permit dossier preparation, document review, eligibility assessments included in the agreed service, and related immigration consulting services. The services provided, applicable fees, payment schedule, and refund conditions must be set out in the client’s written service agreement.

Client Misrepresentation and Inaccurate Information

Clients are responsible for providing complete, accurate, truthful, and authentic information and supporting documents. Where a client provides false information, submits altered documents, conceals material facts, or fails to disclose information relevant to their application, Wilson’s Immigration Pathway may suspend or terminate the service where permitted by the applicable agreement, professional obligations, and law. The consequences of material misrepresentation in an immigration application may include inadmissibility under section 40 of Canada’s Immigration and Refugee Protection Act (IRPA), where the statutory requirements are met. Where the client’s conduct prevents the agreed work from being completed, the refund determination will take account of the services already performed, authorized disbursements, the written agreement, and applicable legal and professional requirements. No refund will be provided for services properly performed and fees properly earned merely because the client supplied inaccurate information or the application encountered difficulties. Any amounts that must be refunded under applicable law or professional rules will be returned.

Refusal to Complete a Required Eligibility Assessment

Before the work permit dossier is prepared or an application is submitted, Wilson’s Immigration Pathway may require a preliminary eligibility assessment where this is part of the agreed service. If a client is informed of the purpose of a required assessment but refuses to provide the necessary information or cooperate with the assessment, the client acknowledges that this may prevent the service from proceeding as planned. The consequences for fees will depend on the written agreement, the work already performed, and applicable law. Any decision to proceed without the assessment must be documented, together with the limitations explained to the client.

Assessment Paid for but Performed Improperly

If a client pays for an eligibility assessment and alleges that it was performed improperly, the matter will be reviewed separately from a client’s refusal to participate in an assessment. Wilson’s Immigration Pathway will review the agreed scope of the assessment, the work performed, the information available at the time, and the nature of the concern. Where a service was not provided as agreed, an appropriate remedy may include correcting the work, completing the outstanding service, or providing a refund or other remedy where required by the agreement, applicable law, or professional obligations. This policy does not exclude a client’s lawful right to raise a complaint or seek an available remedy.

Client Cancellation After Work Has Started

If a client cancels the work permit dossier after work has begun, the fees payable will be determined under the signed service agreement and the applicable professional and legal requirements. The final accounting will reflect the services performed, properly chargeable fees, and authorized disbursements. Any unearned funds or excess funds held in trust that must be returned will be refunded in accordance with applicable requirements. A cancellation does not automatically entitle a client to a full refund of fees for services already properly performed.

Cancellation Before Work Begins

If a client requests cancellation before work begins, the refund will be determined according to the written service agreement and applicable law. Any disclosed and lawful cancellation charge or amount attributable to work already performed or authorized expenses may be considered. No fee will be retained where doing so would contravene applicable legal or professional requirements.

Government Fees and Third-Party Expenses

Government application fees, biometrics fees, medical examination fees, translation fees, and other third-party expenses are separate from Wilson’s Immigration Pathway’s professional fees. Amounts already paid or disbursed to government authorities or third-party providers are subject to the relevant provider’s refund rules. Wilson’s Immigration Pathway cannot guarantee that these external parties will issue refunds. Any client funds received for disbursements will be accounted for in accordance with the applicable service agreement and professional requirements.

Immigration Refusals and No Guarantee of Outcome

Wilson’s Immigration Pathway does not guarantee the approval of a work permit, a job offer, employer support, a labour market impact assessment (LMIA), or any other immigration outcome. Immigration decisions are made by the competent Canadian authorities. A refusal or unfavourable decision does not, by itself, establish entitlement to a refund for services properly performed. Any remedy arising from work not performed as agreed or from another legal or professional obligation remains unaffected.

Termination of Services

Where a service agreement is terminated, the parties’ rights and obligations will be determined under the agreement and applicable law and professional rules. Where the federal Code of Professional Conduct for College of Immigration and Citizenship Consultants Licensees applies, the required final accounting, invoicing, return of client documents, and refund of excess trust funds must be handled in accordance with that Code.

Submitting a Refund Request

All refund and cancellation requests must be submitted in writing to: Email: wilsonmik6850@gmail.com The request should include the client’s full name, service agreement or file reference, payment details, date of payment, and a description of the issue. Each request will be reviewed against the applicable service agreement, the work performed, and relevant legal and professional obligations. The client will be informed of the outcome and any applicable refund calculation.

Applicable Law

This policy is intended to operate consistently with applicable Canadian federal and Alberta law and any professional requirements applicable to the person providing the services. Nothing in this policy limits a right or remedy that cannot lawfully be excluded.
